TERMS AND CONDITIONS
& LIMITATION OF LIABILITY

These Terms and Conditions apply to bookings made from 1 July 2022 onwards.

Please take the time to read and understand the booking conditions set out below before booking a trip with us.

PROXEE TOURS NZ bookings are subject to the following terms and conditions:

All bookings are made with PROXEE LIMITED (NZBN 9429045919664), a registered New Zealand company trading as PROXEE TOURS NZ. By booking a trip with us and paying your deposit, you are deemed to have agreed to these Terms and Conditions, and we will accept your booking on this basis.

Any person making a booking for others shall be deemed to have accepted these Terms & Conditions on behalf of all individuals named in the booking. It is the responsibility of the person making the booking to bring these Terms & Conditions to the attention of all the traveller(s).

PRICES

All prices include a New Zealand Goods and Services Tax (GST) of 15%

The prices are per person in New Zealand dollars and are subject to minimum numbers unless stated.

Prices quoted are subject to change until full payment is received. All mentioned accommodations and activities are subject to availability until the deposit is paid and booking is confirmed within ten business working days after the deposit is received.

PROXEE TOURS NZ reserves the right to correct any pricing errors or omissions.

DEPOSITS AND FINAL PAYMENTS

You must pay a deposit of NZ$199.00 per person per trip for your booking to be confirmed. The balance amount is due 45 days before the start of the tour. For bookings made within 45 days of travel, the total amount is payable at the time of booking. If the balance is not paid on or before the due date, PROXEE TOURS NZ will cancel your booking, and your deposit will be forfeited. At PROXEE TOURS NZ’s discretion, an extension may be given for extenuating circumstances as advised in writing.

Prices are valid for payment by credit card (Visa or Mastercard) or bank deposit. A NZ$25 bank fee applies if paying by an overseas bank. In addition to the tour amount, consider the fees incurred by your bank. The amount received by PROXEE TOURS NZ must be the correct amount invoiced for in New Zealand dollars. PROXEE TOURS NZ is not responsible for bank fees or losses due to the exchange rate. Any shortfall of payment due to exchange rates or bank fees is the responsibility of the tour guest or group. Final documents will be issued once fully paid and the funds are cleared.

Please note that under certain circumstances, we may require an early instalment on your balance of payment before the due date based on vendors’ demands (e.g. domestic airfare, pre-payment terms over peak periods). We will inform you when making your deposit or as circumstances arise. The final balance of payment will be adjusted accordingly.

YOUR DETAILS

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. You must supply us with a passenger booking form for each person, including any pre-existing medical conditions which may affect your ability to participate or complete your travel arrangements.

FINAL GROUP NUMBERS

The final group numbers must be confirmed 45 days before your tour start date. We will also require a complete rooming list that outlines full guest names and bedding configurations. We reserve the right to adjust the tour price for any change in guest numbers.

POSTPONEMENT AND CANCELLATION POLICIES

Please note the following conditions which apply to booking postponement or cancellations made by you for any reason:

We strongly advise taking out travel insurance before booking your trip to protect your travel investment. It should include cancellation insurance. If you cancel your trip, miss a portion of your trip, or leave a trip for any reason after it has commenced, PROXEE TOURS NZ is not obliged to make any refunds in whole or in part, except as provided in these Terms & Conditions.

Postponement Policy

Postponement by the Traveller

  • Postponement of the tour 45 days before the travel date:
    • FREE to change for new travel dates within the 12 months after your original holiday date. Note that rates may differ by tour season. Any price change will be passed on to you. OR
    • We will issue a Gift Card for the value of the payment made (minus any unrecoverable cost) to use for a future holiday of your choice.
  • Postponement of the tour within 45 days before the travel date. The following postponement fees apply:
    • More than 31 days in advance, we’ll issue a Gift Card of 70% (minus any unrecoverable cost).
    • Between 7 and 30 days in advance, we’ll issue a Gift Card of 50% (minus any unrecoverable cost).
    • Less than seven days before the tour, there’s no refund.

The Gift Card is transferrable to family members or friends without change fees and can be applied toward any tours scheduled to depart within 12 months of the original tour date.

Cancellation Policy

Cancellations by the Traveller

  • Deposits are non-refundable.
  • Cancellations 45 days before the travel date:
    • We will issue a refund minus the deposit and any unrecoverable costs.
  • Cancellation within 45 days before the travel date. The following cancellation fees apply:
    • More than 31 days in advance, we’ll refund 70% (minus any unrecoverable cost).
    • Between 7 and 30 days in advance, we’ll refund 50% (minus any unrecoverable cost).
    • Less than seven days before the tour, there’s no refund.

All cancellations must be made in writing to [email protected]. Any potential refunds will be reviewed and processed within 30 days.

Please note the following conditions for cancellations or changes made by PROXEE TOURS NZ to your booking.

Cancellations by us

PROXEE TOURS NZ reserves the right to cancel any tour at any time. Except for the Force Majeure section below, you can transfer any amounts paid to alternate available departure dates within the same tour season or receive a refund minus unrecoverable costs if we cancel a tour. PROXEE TOURS NZ will not be liable for any other payment. We highly recommend travel insurance to cover unforeseen events that might affect your trip.

If a Force Majeure event occurs before or during a tour, such as but not limited to flood, fire, volcanic eruption, earthquake, severe weather, power outages, labour disruptions or other events or natural disasters outside PROXEE TOURS NZ’s control, that hampers or negatively impacts its ability to fulfil any of its contractual obligations. Or if PROXEE TOURS NZ believes that the safety of its guests and the quality of the trip would be compromised due to such disasters or events, PROXEE TOURS NZ reserves the right to truncate, suspend, or cancel the tour and will be excused and released from its obligations without liability of any kind.

In the event of cancellation, PROXEE TOURS NZ is not responsible for any consequential loss incurred by you, including but not limited to the costs of pre or post-tour travel arrangements, cancelled or transferred air tickets, visas, or travel insurance excess. Again, travel insurance is highly recommended to cover any unforeseen circumstances that might affect your trip.

If a service provider cancels a service, activity, or accommodation booking (for example, due to weather), PROXEE TOURS NZ may refund you or offer a suitable alternative. Refunds will not be processed until after PROXEE TOURS NZ has received a refund from the provider.

ITINERARIES

Itineraries are subject to alteration, which may come about due to strikes, road or weather conditions, public holidays, local festivals, or other reasons. Due to the terrain and remote areas, weather fluctuations can adversely affect road conditions that may necessitate alterations to the itinerary with little or no notice. Any additional expense incurred by the passenger is not PROXEE TOURS NZ’s responsibility. PROXEE TOURS NZ cannot guarantee the exact arrival and departure times for carriers and operators used by PROXEE TOURS NZ in the tour, and PROXEE TOURS NZ will not be liable for the failure of any other services or attractions beyond its control.

INSURANCE AND COMPENSATION

We strongly recommend that all travellers in your group obtain travel insurance. At a minimum, it should cover travel delay or cancellation, medical emergencies, loss of luggage and personal effects, and personal liability. Travel insurance can protect you financially from unforeseen circumstances affecting your travel plans. Please advise us of your travel insurance carrier or tell us if you choose to decline travel insurance.

Suppose you choose not to purchase travel insurance as recommended and must cancel your tour for any reason. You will not be entitled to any compensation or refund, either in whole or part, except as provided in the Terms & Conditions.

PASSPORTS AND VISA

All international visitors to New Zealand require a valid passport and a departing air ticket and may require a visa for entry into the country. Passport holders of some countries and territories do not have to apply for a visa. Still, they must hold an NZeTA (New Zealand Electronic Travel Authority) before coming to New Zealand. Please visit the New Zealand immigration website (www.immigration.govt.NZ) for the latest requirements, as they may be subject to change.

While we endeavour to provide you with accurate information, it is the traveller’s responsibility to ensure they have the appropriate travel documents for their nationality and meet the entry requirements. PROXEE TOURS NZ is not liable for any expenses or costs, nor for providing any refunds if you are refused entry to New Zealand because you lack a valid passport, visa, or other travel documents.

FLIGHTS & AIRFARES

International and domestic airfares (unless otherwise specified in the itinerary) are not included in the tour price.

Please inform us of any flight schedule changes or disruptions, or alterations that affect your arrival time or alter your flight number into or within New Zealand.

You must advise PROXEE TOURS NZ immediately as such changes may require an additional transfer, accommodation, third-party operator, and/or administration fees. Travel insurance is recommended to cover such instances.

ITEMS NOT INCLUDED

The tour price does not include international airfares, domestic airfares (unless otherwise specified in the itinerary), visa and passport fees, travel insurance, departure tax, airport transfers (outside the tour schedule),  meals (unless otherwise specified in the itinerary), optional activities, telephone and Wi-Fi charges, laundry costs,  souvenirs and personal purchases.

AIRPORT TRANSFERS

As part of your tour package, we will transfer you from and return you to the airport, provided your transfer is to or from a central city hotel or pickup/dropoff point. We may use one of our service providers for this.

HEALTH & MEDICAL

Our tours may include soft adventures requiring moderate physical fitness to enjoy their activities fully. Please inform us of any health restrictions that are likely to limit your participation or could put you at risk throughout the tour. We can describe activities to the best of our ability and provide details on mandatory health requirements. Still, we are not medical experts. Your suitability for a tour and/or any activities is your responsibility. Please consult with your doctor.

By booking a tour and paying a deposit, you certify that you are mentally and physically fit for our trips and do not have a physical condition or disability that would create a risk to you, our staff, or other travellers. If your situation changes, you must let us know before your arrival. We reserve the right to decline the reservations of or remove from the tour guests who may be at serious risk due to medical conditions or may put fellow travellers at risk.

Whilst we carry first aid kits on all tours, our guides are not medical professionals. They are not authorised to provide medical care or dispense medication. Any medical attention you may require while travelling with PROXEE TOURS NZ may be sought through a local medical facility, with any related charges at your expense.

ACCIDENT COMPENSATION COMMISSION (ACC)

ACC may be able to help with the cost of the treatment and support your need if you are injured while in New Zealand. Please note that ACC only covers treatment and rehabilitation costs in New Zealand; it is not a replacement for travel insurance. It does not cover illness, disrupted travel plans or emergency travel to get you back home.

TOUR GUEST SAFETY AND RESPONSIBILITY

At all times, the decision of the PROXEE TOURS NZ tour director Guide or an activity supplier representative will be final on all matters regarding the safety and wellbeing of tour guests and operational requirements of the tour. By travelling with PROXEE TOURS NZ, the tour guest agrees to abide by the authority of the tour leader or optional activity supplier. We may request you to leave the tour for failure to comply with the tour leader’s decision.

We want our guests to have the best New Zealand experience possible; therefore, guests who, by their actions, are affecting the safety, comfort and enjoyment of other guests or are significantly degrading the experience of any traveller or crew may be asked to leave the tour at the discretion of the tour leader. In this event, they may be left at any city, town, or settlement and PROXEE TOURS NZ and its representatives will not be liable for any expenses incurred by the traveller, including without limitation the costs of meals, transportation, or lodging, nor liable to refund any portion of the tour price.

Tour guests agree that they are responsible for any costs incurred by PROXEE TOURS NZ or tour suppliers due to theft, damage, destruction, or excess cleaning fees related to the guest’s accommodation, transport, or other use of facilities while on Tour.

AGE & PHYSICAL GUIDELINES

Our tours have no age restriction; however, please note that some activities may have age, height, and weight restrictions.

All travellers under the age of 18 must be accompanied by a legal guardian, or in place of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. Car seats are mandatory for children seven years old and below and under 148cm tall. Their use is the caregiver’s responsibility.

PHOTOS & MARKETING

While on your trip, your tour director and fellow travellers may take and share photos, videos, and/or audio records that include your image, voice, or likeness. By agreeing to participate in a tour with Proxee Tours NZ, you consent to the use of your image and/or videos that may be taken during your tour in the marketing and promotional materials of Proxee Tours NZ, including but not limited to the website, social media, print advertising, email advertising, brochures, television advertising, radio advertising, business cards, and any other promotional material at the discretion of Proxee Tours NZ.

PRIVACY POLICY

Your privacy is important to us. The information you provided will be shared only with our suppliers to provide services.

RELEASE & ASSUMPTION OF RISK

You acknowledge that during the tour you are taking with PROXEE TOURS NZ, you may be subject to risks and dangers beyond those you would experience in your typical home and working life. Except as provided in the Consumer Guarantees Act or otherwise implied by law, you agree to assume all risks and hold PROXEE TOURS NZ, its agents, associates, representatives and employees free from all claims whatsoever, including loss, death, injury, or damage, arising out of entering into this agreement and/or participating in the tour. You agree that this obligation and being binding on you personally will also bind your heirs, executors, administrators, successors and assigns, and all your family members.

You also accept that this agreement and the rights and obligations are governed by New Zealand law. The courts of New Zealand will have exclusive jurisdiction to hear and determine all disputes arising out of this agreement and/or the tour.

If any portion of this Contract is determined by a court to be invalid or unenforceable, the remaining parts shall remain valid and enforceable.

Accepting these Terms & Conditions includes accepting this Release and Assumption of Risk.

EXTERNAL SERVICE PROVIDERS

We contract with a network of third-party service providers to assist in running our trips. We may also recommend external service providers that fall outside the scope of our tours in response to requests for pre, post or within-tour assistance. While we endeavour only to use or recommend companies that demonstrate the highest level of service, we cannot guarantee the services provided by third parties and are not liable for any acts, omissions, injury or costs that might arise, nor standards of care that are experienced, in using them. These include any optional activities undertaken during your tour. You accept that any booking assistance provided to you by PROXEE TOURS NZ, including its guides and representatives, for such activities or services does not make us liable for them. Likewise, should you ask us to book directly any activity, accommodation, or service of your choosing, we cannot guarantee nor are we liable for the quality of the provider, its services, or its facilities.

CLAIMS & COMPLAINTS

We pride ourselves on our excellent customer service and the quality of the New Zealand experience we provide. We are dedicated to fair, honest, and reasonable business practices. For any claim or complaint about your experience with us, please inform your tour leader or a PROXEE TOURS NZ representative immediately, so we can resolve the situation promptly.

These Terms & Conditions and General Information are accurate at the time of print. They are subject to change. We recommend checking our website for the latest version prior to booking. The version of the Terms & Conditions and General Information active at the time of your deposit is the version that will apply to your reservation.
